RESO 2020-166 IN THE CITY COUNCIL OF THE CITY OF LIVERMORE, CALIFORNIA A RESOLUTION OF CONTINUED LOCAL EMERGENCY On March 16, 2020, the City Council adopted a resolution, Ratifying the Proclamation of the Director of Emergency Services Concerning the Existence of a Local Emergency(Reso. No. 2020-033). The local emergency proclamation concerns conditions of extreme peril to the safety of persons and property, which have arisen within the City of Livermore due the COVID-19 pandemic. On June 8, 2020, the City Council adopted a resolution, Ratifying the Resolution of Continued Local Emergency (Reso. No. 2020-078). On July 27, 2020, the City Council adopted a resolution, Ratifying the Resolution of Continued Local Emergency(Reso. No. 2020-133). California Government Code section 8630 directs that the City Council shall review the need for continuing the local emergency at least once every 60 days. The State is continuing to implement its four-stage framework to allow Californians to gradually reopen while preserving public health in response to the COVID-19 pandemic. The County of Alameda's Shelter-in-Place order, although modified over the past several months, remains in place and is more restrictive than the State due to the regional effects of COVID-19. In addition, the County remains on the State's Monitoring List, which prohibits certain industries from operating indoors such as schools, shopping malls, places of worship and gyms and fitness centers. With a significant increase in cases throughout the County, the County has paused reopening plans while they monitor the numbers. Due to these conditions, City staff reports that the emergency conditions identified by the proclamation still exist today. Staff recommends the City Council continue the proclamation of a local emergency ratified on March 16, 2020 and continued on June 8, and July 27, 2020. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Livermore has reviewed the March 13, 2020, proclamation of local emergency the City Council ratified on March 16, 2020 (Reso. No. 2020-033) and finds that conditions warrant continued maintenance of that proclamation of local emergency due to the COVID-19 pandemic.
